On the Optimal Patent Policy*

نویسنده

چکیده

Numerous attempts have been made to identify the optimal mix of patent breadth and patent life. Unfortunately, the range of contradictory results reported in literature is rather impressive. The aim of this note is to develop a very stylised model that encompasses a variety of different findings, and to derive a general rule for the optimal patent policy. JEL classification: O34, O31.

The Decision to Patent , Cumulative Innovation , and Optimal Policy ∗

Optimal patent breadth is an issue that is still being vigorously debated at both the theoretical and empirical levels. This paper analyzes optimal patent policy in the context of cumulative innovation in a model that endogenizes the patenting decisions of early innovators. In the theoretical literature on cumulative innovation, it is generally assumed that all innovations are patented. However...

Optimal Patent Length and Patent Width for an Economy with Creative Destruction and Non-Diversifiable Risk

This study examines optimal public policy in a product cycle model where R&D firms innovate and imitate and households face nondiversifiable risk. The government controls product cycles by two policy instruments: patent length, i.e. the expected time an innovation is imitated, and patent width, i.e. the innovator’s profit after a successful imitation relative to that before. The main results ar...

Sequential Innovation , R & D Intensity , and Patent Policy

This paper studies optimal patent policy in a dynamic setting with sequential innovation. Firms innovate by undertaking “research” activities to generate new ideas and by undertaking “developement” activities to commercialize these ideas. To provide firms with incentive to invest in R&D, the social planner grants a monopoly right (patent) to an innovator to exclude its opponent from producing t...

Anticommons and optimal patent policy in a model of sequential innovation

When innovation is sequential, the development of new products depends on the access to previous discoveries. As a consequence the patent system affects both the revenues and the cost of the innovator. We construct a model of sequential innovation in which an innovator uses n patented inputs in R&D to invent a new product. We ask three questions: (i) what is the net effect of patents on innovat...

Patent Protection, Optimal Licensing, and Innovation with Endogenous Entry

How does patent policy affect innovation when patent licensing is crucial for firms? To address this question, the present paper incorporates voluntary patent licensing between an innovator and followers, which has been discussed in the literature of industrial organization, into a dynamic general equilibrium model. Unlike in existing studies, both the licensing fee and the number of licensees ...
